Cancellation Policy
1- If there is inclement weather where the excursion cannot take place, the tour will be rescheduled. If the rescheduling cannot be done, your money will be refunded.
2- To ensure timely processing cancellations must be requested directly to the tour provider (contact information, including phone number will be provided on your voucher) at least 48 hours in advance of the scheduled pick up time or there will be no refund.
3- Tours are non-refundable for no show.
Disclaimer
1- Under no circumstances will iHeartDR or its agents, affiliates, service providers, suppliers, and/or distributors be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of iheartdr.com regardless of the form of action.
2- iHeartDR and its agents and suppliers, in making arrangements for hotels, tours, transportation or any service in connection with the itineraries of individual customers, shall not be liable for injury, damage, loss, accident, delay or irregularity, liability or expense to person or property due to act of default by any hotel, carrier or other company or person providing services included in the tours.
3- Furthermore, iHeartDR and its agents and suppliers accept no responsibility for any sickness, pilferage, labor disputes, machinery breakdown, government restrains, acts of war and/or terrorism, weather conditions, defect in any vehicle of transportation or for any misadventure or casualty or any other causes beyond their control.
4- iHeartDR’s content – including the information, names, images, pictures, logos, prices, dates, and availability regarding or relating to iHeartDR, iheartdr.com and/or to a iHeartDR-affiliated website, service provider, operator and/or distribution partner is provided “AS IS” and on an “AS AVAILABLE” basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
5- At iHeartDR we check and recheck the details about all the products and services we offer for accuracy. However, iHeartDR does not warrant that functionality, content or information contained on iheartdr.com or any iHeartDR-affiliated website will be uninterrupted or error free, that defects will be corrected, or that iheartdr.com or the servers that make it available are free of viruses or bugs.
6- If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
7- iHeartDR is not responsible for photos/videos offered on the excursions. These are provided by third parties and it is the client’s responsibility to bring any inquires to the company from which they were purchased.
The tours offered in iheartdr.com are arranged by different tour operators. This contract between the customer and the tour operator (Hereinafter referred to as the service provider) is subject to the following terms and conditions.
Release/limitations of liabilities
By participating, the customer assumes risk of personal injury, loss or damage to him/herself and his/her personal possessions. The customer releases the service provider from all direct, indirect, punitive incidentals. Special or consequential damages arising from or related to the provision of services, including economic loss, physical or mental injury, or any act, omission or negligence, even if caused in whole or in part by the negligent conduct of the service provider or its employees or agents. If the service provider is unable by law to exclude its liability, the customer agrees that the service provider’s liability is limited to the value of the service purchased.
Indemnification of the Tour Operator
The customer acknowledges having read and understood the Tour Operator’s Terms and Conditions and agrees to discharge and indemnify the Tour Operator with whom the customer travelled from his country of embarkation, his corporate parents, subsidiaries, affiliates, directors, employees, officers and agents from all claims of any nature arising out of such services. The service provider does not have the authority to modify or waive any provision of the Tour Operator’s terms and conditions.
Severability clause
If any portion of this agreement is held invalid or unenforceable, the remaining portion remains in full force and effect; where possible the portion found unenforceable will be construed in a manner consistent with the remaining portions.
Forum
This contract is construed according to the laws of the Dominican Republic and the customer is bound to the jurisdiction of the said courts.
The customer acknowledges having read and understood the above terms and conditions and agrees to be bound by the same. By booking online, the customer will waive certain legal rights, including right to sue for damages.
